Rich's Case: Boroff Vs. Education Board

Boroff	Van Wert City Board of Education	Boroff wore Marilyn Manson T-shirt and the school felt like it was offensive and told him to go home and change it, leave school, or turn the shirt inside out	Boroff argued that his T-shirts are not offensive and are expressing his feelings and he felt there was nothing wrong with his shirt because he was expressing his right of the 1st amendment (right to free expression).	The Principal argued that the Marilyn Manson band is offensive because they promote destructive conductand demoralizing. And their lyrics are demoting and offensive. The principal doesn’t want these bands to influence the students to be destructive	The circuit court’s decided to ban the shirts but not because of the religious offense but the rock band is demoralizing and disruptive and where determined that they are vulgar, offensive, and contrary to the education mission of the school.

This case is very significant because Boroff had a good point because the 1st amendment shows that he has the freedom of expression and he is trying to express himself through his shirts. In this case though Boroff was denied the right because the judges in the courts believe that the shirts are offensive because they demoralize the way we live by influencing bad behavior, and the shirts are offensive to the education mission of the school. Clearly you can see that Boroff’s rights of expression where not protected because the school is blocking his freedom and it is wrong to ban shirts that not only expresses him but shirts that express many people.

Marbury Vs Madison

Mike's post about his case. This one entails the case between two Supreme Court nominees.

Marbury (Supreme Court Justice of the Peace nominee)	Madison (Supreme Court Justice of the Peace nominee)	When President John Adams expired in 1801, the U.S Congress had passed a bill to elect 42 justices to the District of Colombia. Four of the to-be-justices were found without their rights and because of this, they were granted the case Marbury Vs. Madison	Marbury believed that Madison was appointed without proper consent Marbury felt that his rights as a Justice of the Peace commission was wronged.	Madison was taken from office and Marbury was appointed to his position instead And because of this ruling, Judicial Review was established and is still used today.

1. Is it right for the President to appoint judges?

2. Can you protect your rights if you don't know them?

3. Is Judicial Review still a powerful asset today? Or does it deal with smaller, less significant cases?

4. Can you establish principles in law if you cannot establish your own?

5. Is it more powerful to create a bill that pleases the Senate, or fight for the one you think is right...even though you know it doesn't have a chance?

6. Is it right to turn one person down in law just because they do not meet the specific requirement that our country demands? Money, power, social connections?

Marubry Vs. Madison is one of the most reveered and well acknowledged supreme court cases in American history. It involves two individuals who find themselves in court after a dispute over their roles in the Supreme Court. Both men were found at fault, however, Madison was the nominee that found himself in jepordy with the law. This is because President Jefferson appointed Madison out of favor. This was not to be accepted, but at the time, with a dictate, it was actually legal because there was not a law or case that could argue against it. In the end, Judicial Review was established, used today as a powerful tool and can be easily referenced to daily in cases.
